This Privacy Policy describes our commitment to protection of data privacy and how we treat the personal data that we collect from users of the FUJIFILM XApp application software (“Application”). This Privacy Policy applies to the collection, processing and use of personal data which is processed by downloading, installing and using our App.
This Privacy Policy applies to both FUJIFILM and its subsidiaries to the extent applicable related to the processing of data under the conditions defined in this Privacy Policy.

2. Collection and Management of Personal Data
2.1. Downloading / Rating the Application
When downloading the Application or rating the Application through the rating window on it, the necessary information is transferred to the app store, in particular customer ID of the underlying account, time of download, Device code, and rating result. However, we have no influence on this data collection and are not responsible for it.
2.2. Collection of Personal Data
2.2.1. When using the Application, the Application establishes an internet connection and accesses the servers we use to provide the services. When you use the Application, FUJIFILM will collect certain personal data such as the following through services of third parties who have entered into data processing agreements with us:
(a) Country/region of your residence and information you selectively allow us to record as Activity Record (including the shooting location information and thumbnails of images to be posted in the Activity Record), subject analysis information for images transferred from cameras and identification information granted to each application using similar technologies to “Cookies;
(b) Information which you selectively allow us to collect about your Device and OS, version information of the Application, operating information on the Application (including the information about tapped button, number of clicks, page transition, etc), information about your digital camera operation using this Application (including the number of image transferred, remote releases, and digital camera setting backups, etc), Activity Record information about the use of the camera, Equipment information, answers to surveys displayed within our App, subject analysis information for images transferred from cameras and error information of this Application (including communication error, system error, etc); and
(c) User ID(s) of your account which you separately create for products and services provided by third parties such as Facebook, Google, and Apple (“Third Party Account(s)”), which you use to sign-in to Network Service.
(d) Network server access records including IP addresses related to the use of this Application.
The Information described in this section (d) above will be used only for the purposes described in 2.3(a) and 2.3(b).
2.2.2. The information described in the Article 2.2.1(c) is collected by each Third Party Account provider and is provided to us under their privacy policies. For clarification, we will never access or collect any other information about your Third Party Account(s) or provide your other information described in the Article 2.2.1 to such Third Party Account provider.
2.2.3. As set forth in the Article 1 of the “FUJIFILM XApp TERMS OF USE”, since your data for Network Services is managed for each Third Party Account on the Application, please note that:
(i) if you sign-in to the Network Service with multiple Third Party Accounts, your each data associated with each Third Party Account will not be integrated; and
(ii) if you change the Third Party Account for sign-in to the Network Service, your data used for Network Services will not be carried over.
2.2.4. For the purpose of clarification, we will not collect picture data taken with your digital camera which you will send to your Device through the Application, except for thumbnails of images posted in the Activity Record described in the Article 2.2.1(a). Such picture data will only be processed within your digital camera product, this Application and your Device and we will not collect such picture data.
2.2.5. The Application may have or will have added any functions which allow your Device to open and/or start other applications or websites. Your information provided to or collected by such other application or website will be treated by the privacy policy of such other applications or websites and this Privacy Policy will not be applied to such information. Therefore, Private Policy will not apply to your information provided in inquiries and handling of such information either. Please refer to pages showed in another browser.
2.2.6. Network Service includes Google Maps features and content for showing "shooting locations" of the Activity Records pinned on the Google Maps in the Timeline. When you use such Timeline function, you further acknowledge and agree that (a)Google directly collects and receives data from you, including IP addresses and device identifiers of your Device, and latitude/longitude coordinates of each shooting locations, and (b) such Timeline function uses Google Maps Platform API that uses cookies subject to Google's Privacy Policy below, such as calculating daily and 7-day active users and service abuse prevention; however, these cookies are not associated with any signed-in Google Account, if any, and are not logged with the rest of the information collected above. You acknowledge and agree that Google and its affiliates may use and retain such data to provide and improve Google products and services, subject to the Google Privacy Policy at:
By using the Application, you shall be deemed to further agree to the Google Maps Controller-Controller Data Protection Terms below and that you provide device identifiers and your personal data to Google upon the use of Google Maps on the image information display function, subject to the Google Privacy Policy above,
If you don’t agree with this Article 2.2.6, please (i) turn off the "Plot photographing locations on Google Maps" (Settings > Privacy and Security > Plot photographing locations on Google Maps) or (ii) don’t turn on the "Add location for the record" (Settings for the camera > Activity Record settings of the camera > Enabling activity records > Record shutter release event) in the camera setting menu of the Application.
2.3. Purpose of use of Personal data
We process, store and use your personal data for the following purposes:
(a) For providing services related to this Application;
(b) For improving our products and services including Application, developing new ones and to analyzing the demand for our products and services; and
(c) For creating statistical information to be used for market research and marketing purpose without identifying individuals.
The use of personal data provided by you shall be limited to the purposes above. However, we reserve the right to conduct additional processing to the extent permitted or required by relevant laws and regulations, or if we are authorized or required to use your personal data in support of any legal or criminal investigation.
Your personal data will be deleted from service servers of third-parties that have entered into a data processing agreement with us when purpose of processing is completed.
2.4. Data Sharing and Disclosure
We share your personal data when:
(a) your consent is given in advance;
(b) sharing your personal data with affiliated FUJIFILM companies or third party companies processing on our behalf is necessary to implement the purposes provided in the Article 2.3 above;
(c) our business is assigned or transferred either by operation in law or otherwise including mergers, consolidations and dissolution or transfer of operations;
(d) disclosure of your personal data is required by applicable laws and regulations or if we are authorized or required to such disclosure in support of any criminal or other legal investigation or proceeding conducted by relevant authorities; or
(e) there is an immediate need for disclosure to protect human life or human rights.
We will not disclose or supply, share or otherwise distribute your personal data to third parties except as described in this Privacy Policy.
2.5. International Data Transfer
We may transfer the personal data we collect to, and store such information in, other countries which may have different privacy or data protection laws than the country in which the information was collected. For clarification, we may transfer the information described in the Articles 2.2.1 (a) and (d) to Japan and Ireland for the purpose described in the Article 2.3.
2.6. Data Security
FUJIFILM takes adequate technical and organizational security measures in order to protect your personal data from being misused and to prevent the loss of your information. Your personal data is saved in a secure operating environment that is not accessible to the public. All personal data provided by you in the course of registration or use of personalized services will be transferred in encrypted form in order to prevent misuse of it by any third party.
2.7. Your rights relating to your personal data and contact information
In the Application, you can withdraw your consent about collection, use and processing of your personal data set forth in this Privacy Policy at any time with effect for the future.

2.8. Use of Analytics Tool
The Application uses PostHog, web analytics tools provided by PostHog Inc. (i)to collect and process your personal data stipulated in Article 2.2.1(d) through servers of PostHog Inc,’., and (ii) to collect and analyze your personal data stipulated in Article 2.2.1(b) by using “Cookies” or similar technologies.
The Application does not collect advertising IDs or advertising identifiers.

In regard to the use of the PostHog, we execute a data processing agreement with PostHog Inc. to ensure that the data are processed by PostHog Inc. on behalf of us, in accordance with our instructions.
You can disable the collection of the information by PostHog at any time from the “Settings” tab in the Application.
3. Children’s Personal data
We do not knowingly collect or solicit personal data from children defined by local laws. We encourage parents and guardians to take an active role in their children’s online activities and interests. If you are minor, you can’t use the Network Service.
4. Changes to the Privacy Policy
4.1. FUJIFILM reserves the right to change, amend, or update this Privacy Policy. We will notify the change by posting the revised Privacy Policy on the Application. The revised Privacy Policy shall take effect on the effective date set by the FUJIFILM at the time of notification.
4.2. FUJIFILM may change the name of this Application without any notification. this Privacy Policy shall be effectively applied even if the name of this application is changed.
4.3. FUJIFILM may update this Application at its sole discretion in order to improve the security function, fix the defect, add / change / delete the function, etc; provided, however, FUJIFILM do not guarantee the update of this Application. This Privacy Policy shall be effectively applied even if we update this Application.

I hereby accept and declare that I have given my explicit consent to the processing of my personal data within the scope of product and service promotions, informing me about campaigns and promotions, sending me commercial electronic messages with advertising content via push notification - instant mobile notifications - provided that they remain within the principles and purposes specified in the data protection statement.
